1. Purview
These general terms and conditions apply to contracts for the conclusion of an animal sponsorship between Portinus Invest SL registered at Poligono 8, Parcela 171, 07620 Llucmajor, C.I.F. B 57928129, owner of the website
www.fresopolis-mallorca.com (hereinafter “Fresopolis”), and the client, (hereinafter “client”).
2. Customers and sponsors
The client has the option of concluding contracts for one or more sponsorships for himself or for a third person (i.e. to give the sponsorship as a gift). In the latter case, the client and the sponsor are different persons.
3. Sponsorships
3.1 Purpose of animal sponsorship
With an animal sponsorship, the customer supports Fresopolis primarily in the care and accommodation of the sponsored animal(s). Beyond this, the customer supports the initiatives of rescue activities of farm animals in need. If necessary, sponsorship money will also be used for other animals, provided that the current costs for the actual sponsored animal are fully covered.
3.2 A sponsorship runs basically for as long as the client wishes. However, in the event that the sponsored animal is placed in good hands or should it die, the sponsorship for the respective animal ends automatically. After consultation with the sponsor, in these cases the sponsorship will be transferred to another animal.
3.3 An animal sponsorship can be taken on for a minimum period of one month and can be concluded from a minimum amount of € 15 per month. The amount specified in the sponsorship agreement can be paid monthly, quarterly, half-yearly or annually by standing order online or in cash in the case of a permanent sponsorship. The sponsorship is automatically extended for an unlimited period of time as long as Fresopolis has a direct debit mandate. The sponsorship can be terminated monthly (with a notice period of 2 weeks to be submitted) and/or ends automatically in case of non-payment.
3.4 After receipt of payment, each sponsor will be sent a certificate of sponsorship with the photo of the sponsored animal. The animal sponsor can visit his or her animal without prior appointment during the official opening hours or by arrangement on the Fresopolis premises. However, Fresopolis can only guarantee the admission and visit of the sponsored animal upon presentation of a reservation confirmed in writing.
3.5 The acceptance of a sponsorship does not imply any kind of right about the sponsored animal, right of disposal or right to determine the whereabouts of the sponsored animal.
3.6 Our animal sponsorships are partial sponsorships and not exclusive. In this sense, a sponsorship can be concluded for one and the same animal by several sponsors at the same time. It is also possible to take on a sponsorship for a whole group of animals.
4. Use of the contributions
The amounts received by Fresopolis from the customer are freely available to Fresopolis. In this way, the customer also supports the form of agriculture practised at Fresopolis, which follows its own concepts and is aimed at achieving positive effects for the landscape, the regional population and animal welfare.
5. Exclusion of claims
Neither the sponsor nor the customer shall have any claims against Fresopolis arising from the sponsorship which go beyond the content of points 3 and 4.
